Terms of Use

1. Accepting These Terms

These Terms of Use ("Terms") are a binding agreement between you and Concept99Group Franchising, LLC, doing business as Hog-N-Bones ("we," "us," or "our"). They govern your use of our website at https://www.hognbones.com (the "Site"), our mobile app (the "App"), our online menus, and the ordering, loyalty and other features available through them (together, the "Services"). By using the Services, including by browsing the Site, creating a guest account, posting a review or placing an order, you accept these Terms. If you do not agree, please do not use the Services. How we handle personal information is described in our Privacy Policy.

2. Eligibility

The Services are for people age 13 and older. If you are under the age of majority where you live, you may use the Services only with a parent or guardian's involvement and consent, and you may place an order only if that parent or guardian agrees to be responsible for it. By placing an order, you confirm you are authorized to use the payment method you provide.

3. Our Restaurants

Some Hog-N-Bones restaurants are owned and operated by independent franchisees. Your order is prepared and fulfilled by the restaurant you choose. Menus, prices, hours and the features offered (such as online ordering, delivery or catering) can differ by restaurant.

4. Guest Accounts

You may be able to create a guest account to save your information, track loyalty points, manage your preferences and post reviews. You are responsible for keeping your login private, for the accuracy of your account information, and for activity under your account. Tell us promptly if you think someone has used your account. You can stop using the Services or ask us to delete your account at any time.

5. Online Ordering

Your order is an offer. Submitting an order is an offer to buy, which the restaurant may accept or decline (for example, if an item is unavailable, a price was listed in error, or we suspect fraud). Your order is accepted when it is confirmed. If an order is canceled, amounts you paid for it are refunded.
Prices, fees and taxes. Menu items and prices may change without notice and may differ between the Services, our restaurants and third-party marketplaces. Your total includes applicable taxes, any fees shown at checkout, and any tip you choose to add.
Payment. Payments are processed by our third-party payment processor. By submitting payment information, you authorize it to charge your payment method for your order total.
Pickup and delivery. Ready and delivery times are estimates. Please give a complete delivery address and any instructions. If you ask us to leave an order unattended, you are responsible for it once it is delivered as instructed. Deliveries may be made by the restaurant's own staff or by independent third-party delivery providers, who are not our employees or agents.
Problems with an order. Contact the restaurant that prepared your order as soon as possible (its phone number is on our Site), or email us at tysons@c99g.net.
Orders through other apps. If you order our food through a third-party marketplace (such as a delivery app) instead of our Site or App, these Terms do not apply to that order; the marketplace's own terms do, and the marketplace handles its payments, delivery, refunds and support.

6. Loyalty Program

Our loyalty program lets you earn points on eligible purchases and redeem them for rewards, as shown in the program at the time. Points and rewards have no cash value and cannot be sold or transferred. We may change the program's earning rates, rewards and rules, or end the program, with notice where the law requires. We may cancel points or rewards obtained by mistake, fraud or misuse of the program, or in violation of these Terms.

7. Offers, Promotions and Giveaways

Offers and promotions are subject to the terms stated with them, including dates, participating restaurants and limits. Giveaways, contests and sweepstakes we run are governed by their official rules, which control if they differ from these Terms.

8. Text Message and Email Terms

Text messages. If you opt in to Hog-N-Bones marketing texts, you will receive recurring marketing and promotional text messages from us, which may be sent using an automated system. Consent is not a condition of any purchase. Message frequency varies. If you give your phone number with an online order, you may also receive texts about that order. For all texts we send: message and data rates may apply; reply STOP at any time to opt out; reply HELP for help or email tysons@c99g.net; and carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle mobile information and your text opt-in.

Email. You can unsubscribe from marketing emails at any time using the link in each one. We send emails about your orders (such as confirmations) even if you have unsubscribed from marketing emails.

9. Menu, Allergen and Nutrition Information

Menu descriptions and photos are illustrations; actual items may vary. Our kitchens prepare many items in shared cooking and preparation areas, and we cannot guarantee that any item is free of any allergen or that cross-contact will not happen. If you or someone you are ordering for has a food allergy, sensitivity or dietary restriction, please tell the restaurant directly before ordering; do not rely only on menu descriptions or notes added to an online order. Any nutrition information is an estimate and can vary with preparation, portions and substitutions.

10. Reviews and Other Content You Submit

The Services let you submit ratings, reviews, photos and other content ("User Content"). You keep ownership of your User Content, but by submitting it you grant our platform provider, Popmenu, Inc., which builds, hosts and powers the Services, a non-exclusive, royalty-free, worldwide, sublicensable license to host, store, use, reproduce, display and distribute it in connection with the Services (for example, showing your review on our menu or in our marketing). This license continues after you stop using the Services, though you may ask us to delete your account and reviews.

You are responsible for your User Content. Do not submit anything false or misleading, unlawful, defamatory, obscene, harassing or discriminatory; anything that infringes someone else's intellectual property, privacy or publicity rights; other people's personal information; or spam, advertising or malicious code. Reviews must reflect your genuine experience; do not post reviews in exchange for undisclosed compensation or post fake reviews. We may, but do not have to, monitor User Content, and we may remove or decline to show any of it at any time. Ratings and reviews are public.

11. Acceptable Use

Use the Services only for their intended purposes and in line with the law. You will not: (a) interfere with or disrupt the Services or get around any security or access controls; (b) use bots, scrapers or other automated means to access or collect information from the Services; (c) copy, frame or mirror any part of the Services; (d) impersonate anyone or misrepresent your affiliation; (e) place fraudulent orders or misuse offers, promotions or the loyalty program; or (f) send malicious code or unlawful material through the Services. We may suspend or end your access for violations (Section 18).

12. Intellectual Property

The Services and their contents are protected by intellectual property laws. The Hog-N-Bones name, logos and trademarks, and the content we provide (such as our menus, text and images), are owned by or licensed to us. The software, design and technology of the Services, including the platform, templates and features they run on, are owned by Popmenu, Inc. and its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. No other rights are granted, and you may not use our name, logos or content, or copy any part of the Services, without our written permission or that of the owner. If you believe content on the Services infringes your copyright, email tysons@c99g.net with enough detail for us to review your claim.

13. Third-Party Services and Links

The Services rely on and may link to services run by others, such as payment processors, delivery providers and social media platforms. We do not control them and are not responsible for their content, availability or practices; their own terms and privacy policies apply. A link is not an endorsement.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT INFORMATION ON THEM (SUCH AS HOURS, PRICES AND MENU ITEMS) IS ACCURATE, COMPLETE OR CURRENT. THIS SECTION DOES NOT DISCLAIM ANY WARRANTY OR RIGHT THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, AND IT DOES NOT APPLY TO THE FOOD AND BEVERAGES WE SELL, WHICH REMAIN SUBJECT TO ANY NON-WAIVABLE WARRANTIES AND FOOD-SAFETY LAWS.

15. Limitation of Liability

TO THE FULLEST EXTENT THE LAW ALLOWS: (A) NEITHER WE NOR OUR LICENSORS, SUPPLIERS OR SERVICE PROVIDERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES; AND (B) TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM OR $100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY ARISING FROM THE FOOD AND BEVERAGES WE SELL. SOME PLACES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us at tysons@c99g.net and give us 30 days to try to resolve it informally. Any dispute that is not resolved informally will be brought only in the state or federal courts for Ware County, Georgia, and you and we consent to their jurisdiction, except that either of us may bring a qualifying claim in small claims court.

17. Changes to These Terms

We may update these Terms. We will post the new version here with a new "Last Updated" date and give reasonable additional notice of material changes (such as a notice on the Site or App). Changes apply going forward. Continuing to use the Services after changes take effect means you accept them. If you do not agree, stop using the Services.

18. Ending Access

We may suspend or end your access to the Services (including any guest account or loyalty account) if we reasonably believe you have violated these Terms or the law, or to protect the Services or others. You may stop using the Services at any time. Sections that by their nature should survive (including Sections 6, 10, 12 and 14 through 19) survive.

19. General

These Terms are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of our business. Nothing in these Terms creates a partnership, employment or agency relationship. Popmenu, Inc. is an intended third-party beneficiary of Sections 10, 11, 12, 14 and 15 and may enforce those Sections directly against you. Otherwise, these Terms create no rights for any third party.

20. Accessibility

We want the Services to work for everyone. If you have trouble using any part of the Services, or need these Terms, our menu or other information in another format, email tysons@c99g.net or call the restaurant, and we will help you get the information or complete your order another way, such as by phone.
